Our company leases, operates, and maintains carefully selected vacation homes in desirable destinations, ensuring every property reflects the comfort, quality, and service standards associated with LUCHA Vacation Rentals VBA.
Our objective is to redefine alternative accommodations by offering guests unique and memorable stays in fully managed homes. Whether reservations are made directly through our website or through third-party booking platforms such as Airbnb, VRBO, Booking.com, Marriott Homes & Villas, or similar providers, guests acknowledge that the accommodation is operated and managed by LUCHA Vacation Rentals VBA.
User Requirements, Identity Verification & Background Checks
To use our website or make a reservation through our platform, you must be at least 18 years of age. LUCHA Vacation Rentals VBA reserves the right to require a higher minimum age for specific properties or reservations.
When creating an account or making a reservation, guests are required to provide accurate, complete, and current information for themselves and all members of their reservation party. Account holders are responsible for maintaining updated account information at all times and may not transfer accounts to third parties or create multiple accounts under false identities.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. If you believe your account has been compromised or accessed without authorization, you must notify LUCHA Vacation Rentals VBA immediately.
Where permitted by applicable law, LUCHA Vacation Rentals VBA may perform identity verification procedures, fraud prevention reviews, and background screenings to protect our properties, homeowners, staff, vendors, and guests. This may include requesting identification documents, verifying personal information, consulting third-party databases, or reviewing publicly available records. By making a reservation, you authorize LUCHA Vacation Rentals VBA to use the personal information provided for these verification purposes and acknowledge that reservations may be declined, suspended, or canceled at our sole discretion based on the outcome of such screenings.
By accepting these Terms, you confirm that you are legally capable of entering into this Agreement, that you have not previously been removed from our services or properties, and that your use of the platform complies with all applicable laws and regulations. If you are entering into this Agreement on behalf of a company or organization, you confirm that you have the authority to legally bind that entity.
Intellectual Property & Trademark Use
The name LUCHA Vacation Rentals VBA, including all related logos, slogans, branding materials, website designs, photographs, graphics, and visual elements, are the exclusive property of LUCHA Vacation Rentals VBA and are protected by applicable intellectual property laws.
No part of our branding, trademarks, website content, or visual identity may be copied, reproduced, modified, distributed, or used without prior written consent from LUCHA Vacation Rentals VBA. You may not use any branding, domain name, social media handle, or other identifier that could create confusion regarding affiliation with LUCHA Vacation Rentals VBA or damage the reputation of the company.

All materials displayed on our website, including text, software, images, videos, graphics, music, layouts, and other content, are owned or licensed by LUCHA Vacation Rentals VBA and are protected under copyright, trademark, and intellectual property laws.

Software & Platform Use Restrictions

Force Majeure
LUCHA Vacation Rentals VBA shall not be held responsible for delays, interruptions, cancellations, damages, or inability to fulfill obligations resulting from circumstances beyond our reasonable control. Such circumstances may include severe weather, natural disasters, government restrictions, travel disruptions, utility outages, internet interruptions, pandemics, labor disputes, acts of war, terrorism, or similar unforeseen events.
Refunds or compensation may not be provided for circumstances classified as force majeure events.
Limitation of Liability
To the fullest extent permitted by law, LUCHA Vacation Rentals VBA, including its affiliates, employees, contractors, managers, and representatives, shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from the use of the website, accommodations, concierge services, or related offerings.
This limitation includes, but is not limited to, claims involving property damage, personal injury, emotional distress, loss of enjoyment, travel disruptions, service interruptions, or third-party conduct. Under no circumstances shall the total liability of LUCHA Vacation Rentals VBA exceed two hundred U.S. dollars (USD $200) in aggregate.
Mediation & Legal Disputes
LUCHA Vacation Rentals VBA values customer satisfaction and encourages guests to first contact our support team regarding any concerns or disputes related to reservations, accommodations, or services.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before initiating arbitration or court proceedings. Mediation costs shall generally be shared equally by the parties involved. If mediation does not result in a resolution within sixty (60) days, either party may proceed with legal action or mutually agreed arbitration.
All disputes must be brought individually, and guests waive the right to participate in class actions, representative claims, or jury trials.
Governing Law & Jurisdiction
These Terms and any disputes arising from the use of the website or services shall be governed by the laws of Aruba, without regard to conflict of law principles.
Any legal proceedings relating to these Terms shall be handled exclusively within the courts of Aruba, and all parties consent to the jurisdiction of those courts.
Suspension & Termination
LUCHA Vacation Rentals VBA reserves the right to suspend, restrict, or terminate access to the platform, services, reservations, or accounts at its sole discretion. This includes situations involving violations of these Terms, fraudulent activity, repeated cancellations, abusive conduct, or misuse of the platform.
Indemnification
Guests agree to indemnify and hold harmless LUCHA Vacation Rentals VBA, including its affiliates, employees, contractors, and representatives, against any claims, damages, losses, liabilities, or legal expenses arising from guest conduct, property damage, violations of these Terms, or misuse of the accommodations or platform.
Modifications to Terms
LUCHA Vacation Rentals VBA reserves the right to modify or update these Terms at any time. Updated Terms become effective immediately upon publication on the website unless otherwise stated. Continued use of the platform or services after changes are published constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.
Entire Agreement
These Terms, together with all related policies and guidelines referenced herein, constitute the complete agreement between you and LUCHA Vacation Rentals VBA regarding the use of the website, reservations, accommodations, and related services.
By accessing the platform, creating an account, or booking a reservation, you acknowledge that you have read, understood, and agreed to these Terms on behalf of yourself and all members of your reservation party.
Promotional Campaigns & Discount Terms
Promotional offers, discounts, and coupon codes issued by LUCHA Vacation Rentals VBA are subject to availability and may be modified, suspended, or canceled at any time without prior notice.
Promotions may only apply during specific booking or travel periods and cannot be applied retroactively to existing reservations. Certain properties or destinations may be excluded from promotional campaigns at the sole discretion of LUCHA Vacation Rentals VBA.
All promotional reservations remain subject to the standard cancellation policies and any additional terms associated with the specific campaign or offer.

1. Introduction
This Guest Agreement (“Agreement”) is made between you, (“Guest,” “you,” or “your”), and LUCHA Vacation Rentals VBA (“LUCHA Vacation Rentals VBA,” “we,” “our,” or “us”), acting either on its own behalf or, where applicable, on behalf of the property owner.
This Agreement outlines the responsibilities, obligations, and conduct expected from you, your travel companions, guests, visitors, or any other individuals associated with your reservation during your stay at any accommodation managed, operated, or offered by LUCHA Vacation Rentals VBA (the “Property” or “Accommodation”).
By accessing our website, making a reservation, or staying at one of our properties, you acknowledge and agree to comply with this Agreement, including our Site Terms of Use and Privacy Policy, which are incorporated herein by reference. Guests using concierge or additional hospitality services also agree to follow all applicable Concierge Service Policies.
You further understand and acknowledge that this Agreement includes both LUCHA Vacation Rentals VBA’s general House Rules, applicable to all accommodations, as well as any specific rules or instructions relating to the particular property reserved by you.
As the primary reservation holder, you accept full responsibility for ensuring that all members of your group, including visitors and invited guests, comply with this Agreement and all applicable property rules throughout the duration of the stay.
If you reserve an Accommodation through a third-party booking platform or online travel agency (each an "OTA"), the OTA's terms and conditions will apply to your stay and if in conflict with these terms, will supersede.
Rental Terms
When reserving an Accommodation through our website or booking platform, you agree to pay all charges associated with your reservation, including the nightly rental rate, applicable taxes, cleaning fees, service fees, and any additional charges presented during the booking process (collectively referred to as the “Total Reservation Amount”).
Guests acknowledge that access to the property and check-in instructions will only be provided once the full reservation balance has been successfully received and all required procedures have been completed. This may include identity verification, guest screening processes, signing required waivers or rental agreements, and, where applicable, approval or documentation required by homeowner associations or building management.
By submitting payment for your reservation, you confirm that you have reviewed and accepted the terms outlined in this Agreement and all related policies of LUCHA Vacation Rentals VBA.
The primary guest listed on the reservation remains financially responsible for the full booking amount, including any approved extensions, additional services, or applicable charges incurred during the stay.
You further authorize LUCHA Vacation Rentals VBA to charge additional amounts when necessary for damages, excessive cleaning, missing items, rule violations, unauthorized occupancy, or other costs resulting from the actions of you or anyone associated with your reservation during the stay.
Subject to full payment of your reservation and compliance with this Agreement, LUCHA Vacation Rentals VBA grants you a temporary and limited right to access, occupy, and use the reserved Accommodation solely for approved short-term vacation purposes during the confirmed booking period.
This right of occupancy does not create a tenancy, leasehold interest, or ownership right in the property. During your stay, and where permitted under applicable law, LUCHA Vacation Rentals VBA reserves the right to access or re-enter the Accommodation when reasonably necessary, including for inspections, maintenance, emergencies, safety concerns, rule enforcement, or protection of the property.
Identity Verification
To help maintain the safety, security, and integrity of our properties and guest community, LUCHA Vacation Rentals VBA may require all guests to complete an identity verification process prior to check-in. These verification procedures are intended to help prevent fraud, unauthorized bookings, identity misuse, and other security-related risks. In certain cases, verification requirements may be waived if the reservation was made through a third-party booking platform that already provides sufficient identity verification measures acceptable to LUCHA Vacation Rentals VBA.
Guests who fail to provide requested information, submit incomplete or inaccurate details, or do not successfully complete the verification process may have their reservation declined, suspended, or canceled at the sole discretion of LUCHA Vacation Rentals VBA.
The duration of the stay is as agreed upon at the time of booking.
Check-in time is 4:00 PM. Early check-in (as early as 2:00 PM) may be available for $50, subject to availability and prior approval.
Check-out time is 10:00 AM. Late check-out (until 12:30 PM) may be available for $50, subject to availability and prior approval.
Payments, Taxes, Damage & Deposits and Charges
Taxes
Depending on the location of the property and applicable local regulations, reservations made through LUCHA Vacation Rentals VBA may be subject to certain taxes and governmental charges. These may include, but are not limited to, sales tax, lodging tax, tourist tax, occupancy tax, hospitality tax, city tax, value-added tax, or similar regulatory fees (“Taxes”).
Applicable taxes are calculated based on the reservation amount, accommodations booked, and any additional services purchased. Tax rates may vary depending on the jurisdiction in which the property is located and the regulations in effect at the time of the reservation or stay.
In certain destinations, LUCHA Vacation Rentals VBA may be legally obligated to collect and remit these taxes directly to local authorities on behalf of guests.
Damage Deposit Policy
Certain properties managed by LUCHA Vacation Rentals VBA may require a non-refundable Damage Deposit as part of the reservation. The amount of the Damage Deposit is property-specific and will be clearly communicated during the booking process or prior to check-in.
This Damage Deposit is intended to provide limited coverage for accidental damages that may occur during the stay. The applicable deposit amount for the reserved property will determine the maximum coverage available under this policy.
Guests acknowledge that this Damage Deposit is not an insurance policy and does not remove or limit guest responsibility for damages, losses, violations, or costs that exceed the applicable deposit amount or fall outside the scope of covered incidents.
Covered Damages
The Damage Deposit may be used toward the repair, replacement, or restoration of accidental damage caused during the reservation period to items or areas within the property, including but not limited to furniture, appliances, fixtures, household items, flooring, carpets, rugs, walls, doors, windows, or similar property components belonging to the homeowner or LUCHA Vacation Rentals VBA.
Exclusions
The Damage Deposit does not apply to intentional damage, vandalism, theft, reckless behavior, gross negligence, or damages caused by unauthorized guests, parties, events, or pets.
The policy also excludes:
Missing keys, remotes, or access devices
Excessive cleaning beyond standard turnover cleaning
Smoking-related damages or odor removal
Regulatory fines or HOA penalties
Costs associated with guest removal or eviction
Damages exceeding the applicable deposit amount for the property
Additional Damage Charges
If damages, losses, or related expenses exceed the applicable Damage Deposit amount, the primary guest listed on the reservation remains fully responsible for all additional costs.
LUCHA Vacation Rentals VBA and/or the property owner may provide supporting documentation, including photographs, invoices, estimates, receipts, or repair reports relating to the damages incurred. Outstanding balances must be paid within three (3) days of written notification unless otherwise agreed in writing.
Because the Damage Deposit is non-refundable, no portion of the deposit will be refunded after the stay, regardless of whether damages occurred.
Reporting Damage
Guests are expected to immediately report any accidental damage, malfunction, maintenance issue, or incident occurring during the stay. Any such issue must be reported as soon as reasonably possible and no later than twenty-four (24) hours after discovery.
Failure to disclose damages or incidents may result in additional charges, penalties, or further claims for compensation.
Normal Wear and Tear
Standard wear and tear resulting from ordinary and reasonable use of the property will not be considered chargeable damage under this policy.
Travel Insurance Recommendation
LUCHA Vacation Rentals VBA strongly recommends that guests obtain travel insurance coverage that includes protection against accidental damage to vacation rental properties, trip interruptions, cancellations, and liability-related incidents during travel.
If the property is returned in good condition with no damage, missing items, or excessive cleaning required, the deposit will be fully refunded.
Any remaining balance will be refunded once the inspection is complete.
Authorized Use; Guest Responsibility
The Accommodation may only be used as a private short-term vacation rental by the primary guest and the registered occupants included in the reservation. The primary guest accepts full responsibility for the conduct, behavior, and actions of all individuals staying at or visiting the property during the reservation period.
If multiple individuals are listed as guests on the reservation, each guest shall be jointly and individually responsible for complying with all obligations, rules, payment responsibilities, and terms outlined in this Agreement. Any financial obligations, damages, fees, penalties, or liabilities arising under this Agreement shall remain enforceable until fully resolved and paid.
Maximum Occupancy
Guests agree not to exceed the maximum occupancy limit specified for the reserved Accommodation or listed within the reservation details, unless prior written authorization has been provided by LUCHA Vacation Rentals VBA.
All guests and visitors must vacate the property no later than the scheduled check-out date and time stated in the reservation confirmation, unless a late check-out or extension has been approved in writing.
Unauthorized overnight guests, exceeding occupancy limits, or hosting unapproved visitors, gatherings, or events may result in immediate cancellation of the reservation, additional charges, removal from the property, or other actions permitted under applicable law.
LUCHA Vacation Rentals VBA reserves the right to require guests to vacate the Accommodation if occupancy limits or reservation terms are violated. In such cases, guests may be subject to additional fees and shall not be entitled to refunds, credits, or compensation related to the early termination of the stay.
Unauthorized Stay Beyond Check-Out
Guests are required to vacate the Accommodation no later than the agreed check-out date and time stated in the reservation confirmation, unless an extension has been approved in writing by LUCHA Vacation Rentals VBA.
Any continued occupancy of the property after the authorized check-out time without prior approval shall be considered an unauthorized holdover stay. In such circumstances, the guest’s temporary right to occupy the Accommodation immediately terminates, and LUCHA Vacation Rentals VBA reserves the right to require the guest and all occupants to vacate the property in accordance with applicable laws and regulations.
Guests acknowledge and agree that LUCHA Vacation Rentals VBA, its representatives, property managers, security personnel, or local authorities may take reasonable actions necessary to regain possession of the property if an unauthorized holdover occurs.
If personal belongings remain in the Accommodation following an unauthorized stay, LUCHA Vacation Rentals VBA may remove and relocate such belongings to a storage location or other reasonable location at the guest’s expense. LUCHA Vacation Rentals VBA shall not be held responsible for loss, theft, damage, or deterioration of any items removed or stored.
Guests further agree that any unauthorized occupancy beyond the approved reservation period may result in substantial additional charges. For every additional twenty-four (24) hour period, or portion thereof, guests may be charged up to two (2) times the standard undiscounted nightly rate applicable to the property, in addition to any related costs, damages, penalties, or losses incurred by LUCHA Vacation Rentals VBA or the property owner.
Additional charges may include, but are not limited to:
Lost revenue from canceled or relocated reservations
Costs associated with alternative accommodations for incoming guests
Operational disruptions
Legal expenses
Security or removal-related costs
Additional taxes and service fees
Guests authorize LUCHA Vacation Rentals VBA to charge the payment method on file and/or apply any available deposit toward the recovery of such amounts related to unauthorized holdover occupancy.
Cancellation Policy
Cancellation policies may vary with each Property. See listings for additional details. Please note that if your reservation dates have been moved, all cancellation policies remain attached to your original reservation date.
Cancellation or Relocation by LUCHA Vacation Rentals VBA
LUCHA Vacation Rentals VBA reserves the right to cancel, modify, or relocate a reservation if the reserved Accommodation becomes unavailable, unsafe, inaccessible, or otherwise unsuitable for occupancy due to circumstances beyond our reasonable control or operational limitations.
This may occur because of maintenance emergencies, utility interruptions, guest overstays, weather-related issues, accidental double bookings across booking platforms, changes in ownership or management, licensing or regulatory restrictions, safety concerns, HOA limitations, government actions, or other unforeseen situations affecting the property.
In situations where the originally reserved property cannot be provided, LUCHA Vacation Rentals VBA may, where reasonably possible, offer the guest a comparable alternative accommodation with similar standards, size, quality, or location.
If a suitable replacement property is not available, or if the guest chooses not to accept the alternative accommodation offered, LUCHA Vacation Rentals VBA may cancel the reservation and issue a full refund for all amounts paid relating to the booking.
Any refund issued under these circumstances shall represent the full extent of LUCHA Vacation Rentals VBA’s obligation and liability regarding the cancellation, unavailability, or substitution of the reserved Accommodation, except where otherwise required under applicable law.
Safety, Surveillance & Security
Guests acknowledge and agree that properties managed by LUCHA Vacation Rentals VBA may contain various safety and monitoring systems intended to protect guests, neighboring properties, homeowners, and the Accommodation itself. These systems may include smoke detectors, carbon monoxide detectors, fire alarms, pool gates, pool safety devices, security systems, or noise monitoring technology, depending on the property and applicable legal requirements.
Guests agree not to tamper with, disable, remove, obstruct, or interfere with any installed safety or monitoring equipment under any circumstances. Any malfunction, damage, safety concern, or maintenance issue involving these systems must be reported to LUCHA Vacation Rentals VBA immediately. The intentional disabling or removal of safety devices shall be considered a serious violation of this Agreement and may result in immediate termination of the reservation and removal from the property.
Guests further understand and acknowledge that certain properties may utilize exterior video surveillance systems for security, property protection, rule enforcement, and compliance with local regulations or community guidelines. Exterior cameras may operate continuously and may monitor areas such as entrances, driveways, parking areas, gates, and other outdoor spaces. No surveillance devices will be placed inside private interior living spaces or areas where guests have a reasonable expectation of privacy, in accordance with applicable privacy laws.
Certain properties may also include noise monitoring technology designed to measure sound levels and help prevent excessive noise disturbances within residential communities. These systems do not record conversations or audio content but may alert LUCHA Vacation Rentals VBA to elevated noise levels that could violate house rules or local regulations.
LUCHA Vacation Rentals VBA may also implement additional security measures, patrols, access controls, or monitoring procedures at its discretion. Such measures may be modified, expanded, reduced, or discontinued at any time without prior notice whenever deemed necessary for operational, safety, or security purposes.
Personal Property, Liability & Injury
LUCHA Vacation Rentals VBA does not provide insurance coverage for the personal belongings, valuables, vehicles, or other property of guests, occupants, or visitors staying at the Accommodation. Guests acknowledge that any personal property brought onto the premises is done entirely at their own risk.
LUCHA Vacation Rentals VBA shall not be responsible for loss, theft, damage, or destruction of personal belongings caused by fire, water intrusion, weather conditions, vandalism, criminal acts, negligence of third parties, utility interruptions, or any other unforeseen circumstances.
Guests further acknowledge that the use of the property and its amenities, including but not limited to pools, hot tubs, docks, balconies, stairs, outdoor areas, fitness equipment, recreational facilities, or playground equipment, involves inherent risks. The primary guest accepts full responsibility for their own safety and the safety of all occupants, guests, children, and visitors during the stay.
Children must be supervised at all times while using any amenities or while present on the property.
Except in situations directly resulting from the gross negligence or intentional misconduct of LUCHA Vacation Rentals VBA or its authorized representatives, guests agree to release, defend, indemnify, and hold harmless LUCHA Vacation Rentals VBA, its property owners, affiliates, employees, contractors, agents, and representatives from any claims, liabilities, damages, losses, injuries, disputes, legal proceedings, costs, or attorney fees arising from the actions, conduct, negligence, or use of the property by guests or any member of their party.
Guests also acknowledge and agree that LUCHA Vacation Rentals VBA shall not be liable for injuries, damages, losses, inconveniences, delays, or interruptions occurring during the stay unless directly caused by proven negligence or intentional wrongdoing on the part of LUCHA Vacation Rentals VBA.
This limitation of liability includes, but is not limited to:
Theft or burglary
Water leaks or flooding
Smoke or fire damage
Mold or environmental conditions
Pest or vermin issues
Utility outages
Internet or cable interruptions
Mechanical failures
Temporary service disruptions
LUCHA Vacation Rentals VBA strongly recommends that guests obtain appropriate travel insurance or personal liability coverage to protect themselves, their companions, and their personal belongings during travel and occupancy of the property.
Maintenance, Utilities & Equipment
LUCHA Vacation Rentals VBA strives to ensure that all property systems, appliances, amenities, and utilities are functioning properly prior to guest arrival. However, guests understand and acknowledge that occasional mechanical failures, service interruptions, or maintenance-related issues may occur during a stay.
LUCHA Vacation Rentals VBA cannot guarantee uninterrupted operation of heating systems, air conditioning units, kitchen appliances, televisions, entertainment systems, internet services, pools, spas, plumbing, electrical systems, windows, roofing, utilities, or other property features and amenities.
Guests are required to promptly report any malfunction, maintenance concern, or inoperative equipment to LUCHA Vacation Rentals VBA as soon as reasonably possible so appropriate efforts can be made to address the issue.
While LUCHA Vacation Rentals VBA will make commercially reasonable efforts to coordinate repairs and resolve reported issues in a timely manner, guests acknowledge that certain repairs may depend on vendor availability, replacement parts, weather conditions, utility providers, HOA restrictions, or circumstances beyond our control. Accordingly, LUCHA Vacation Rentals VBA cannot guarantee that all maintenance issues will be resolved during the guest’s stay.
Guests further acknowledge and agree that refunds, credits, rent reductions, or compensation will not be issued due to temporary maintenance issues, appliance malfunctions, utility interruptions, internet outages, nearby construction activity, noise disturbances, or similar inconveniences beyond our reasonable control.
If troubleshooting instructions provided remotely by LUCHA Vacation Rentals VBA staff do not resolve the issue, maintenance personnel, technicians, or third-party vendors may be dispatched to the property to further investigate or address the concern.
Cleaning Policy
All properties managed by LUCHA Vacation Rentals VBA are professionally cleaned and prepared prior to guest arrival in accordance with company cleaning standards.
Standard reservations do not include daily housekeeping services unless specifically stated otherwise. Guests may request additional housekeeping or mid-stay cleaning services during their reservation for an additional charge, subject to availability and scheduling.
The standard cleaning fee included within the reservation covers routine post-checkout cleaning under normal usage conditions. Guests acknowledge that excessive dirtiness, unreasonable trash accumulation, smoking-related cleanup, bodily fluids, stains, odors, or abnormal property conditions requiring additional labor or specialized cleaning may result in extra cleaning charges.
If LUCHA Vacation Rentals VBA determines that the condition of the property after checkout exceeds normal cleaning expectations, guests authorize LUCHA Vacation Rentals VBA to charge the payment method on file for additional cleaning costs reasonably incurred.
House Rules
The following House Rules apply to all properties managed by LUCHA Vacation Rentals VBA and form part of the Guest Agreement. Additional property-specific rules, instructions, or community regulations provided within the house manual, welcome guide, or check-in instructions are also considered part of this Agreement and must be followed at all times.
Guests acknowledge that many vacation rental properties are located within residential neighborhoods or private communities. Respect toward neighbors, homeowners, staff, vendors, and the surrounding community is required throughout the duration of the stay.
Failure to comply with local laws, HOA regulations, community guidelines, or these House Rules may result in immediate cancellation of the reservation, removal from the property without refund, additional penalties, fines, damage charges, or legal action. Certain violations may also result in fines up to USD $20,000 depending on the severity of the incident, property damage, regulatory consequences, or community-imposed penalties.
Occupancy Limits
Guests may not exceed the maximum occupancy limit approved for the reservation unless prior written approval has been obtained from LUCHA Vacation Rentals VBA.
Unauthorized overnight visitors or additional guests are strictly prohibited. If the number of occupants exceeds the approved limit, guests agree to pay a penalty fee of USD $500 per unauthorized person in addition to any other applicable fees, damages, or consequences resulting from the violation.
Noise & Quiet Hours
Guests must avoid excessive noise, disturbances, or disruptive behavior at all times. Quiet hours are strictly enforced between 9:00 PM and 8:00 AM unless otherwise specified in writing for the property.
Music, amplified sound, outdoor speakers, shouting, or other excessive noise may not disturb neighboring properties or violate local regulations. Outdoor sound levels must remain within acceptable community standards at all times and are not permitted during quiet hours.
Certain neighborhoods, condominium associations, or municipalities may impose stricter noise restrictions, which guests are also required to follow.
Smoking Policy
Smoking is strictly prohibited inside the property and may also be prohibited in outdoor areas depending on the property rules or HOA regulations.
Guests accept responsibility for all damages, odor remediation, cleaning costs, fines, or additional expenses resulting from smoking, vaping, or the use of tobacco or other substances at the property.
Pet Policy
Pets are only permitted at designated pet-friendly properties and must be approved prior to arrival. Additional pet fees, deposits, or cleaning charges may apply depending on the property.
Unauthorized pets constitute a violation of this Agreement and may result in penalties of USD $100 per day in addition to cleaning fees, damages, or reservation termination.
Where required by applicable law, approved service animals will be accommodated in accordance with LUCHA Vacation Rentals VBA policies.
Guests remain fully responsible for any damage, excessive cleaning, disturbances, injuries, or issues caused by animals brought onto the property. All approved pets must be properly vaccinated, house-trained, non-aggressive, and free of fleas or ticks.
Parking Rules
Guests may not exceed the maximum number of permitted vehicles associated with the reservation or property guidelines.
Guests are solely responsible for complying with all parking rules, HOA regulations, local street parking laws, towing zones, permits, and community restrictions. Any fines, towing expenses, penalties, or violations resulting from improper parking remain the responsibility of the guest.
Events, Parties & Gatherings
LUCHA Vacation Rentals VBA properties are intended for approved vacation stays and small gatherings involving registered guests only. Unauthorized parties, events, celebrations, commercial activities, or large gatherings are strictly prohibited.
No event or gathering may:
Exceed the approved occupancy limit
Include unregistered visitors beyond permitted capacity
Create excessive noise or disturbances
Violate quiet hour rules
Disrupt neighbors or the surrounding community
Violate HOA, municipal, or safety regulations
Any organized event, celebration, filming activity, wedding, gathering, or third-party vendor service must receive prior written approval from LUCHA Vacation Rentals VBA and may require a separate event agreement, insurance documentation, permits, security arrangements, parking plans, or additional fees.
Guests intending to host any gathering or bring third-party vendors onto the property must contact LUCHA Vacation Rentals VBA in advance for approval and coordination.
If an unauthorized event, party, or prohibited gathering is discovered, LUCHA Vacation Rentals VBA, property management personnel, security representatives, or authorized agents may immediately enter the property to investigate, remove unauthorized persons, and enforce compliance with this Agreement.
Guests acknowledge that violations involving unauthorized events or parties may result in immediate termination of the reservation without refund. In such cases, all amounts previously paid may be forfeited, and guests may additionally be held financially responsible for damages, security expenses, HOA fines, neighborhood complaints, operational disruptions, and liquidated damages comparable to LUCHA Vacation Rentals VBA’s standard event-related fees.
No Commercial Use, Filming or Photography
The Accommodation may only be used for approved residential vacation purposes. Guests and registered occupants may not use the property for commercial activities, professional productions, business operations, advertising campaigns, events, content creation, filming, photography shoots, music videos, social media productions, or similar activities without prior written authorization from LUCHA Vacation Rentals VBA.
Any unauthorized commercial filming, photography, audio recording, or production activity conducted at the property shall constitute a material violation of this Agreement and may result in immediate cancellation of the reservation, removal from the property without refund, additional fees, and potential legal action.
In the event unauthorized commercial content created at the property is published, distributed, monetized, licensed, or otherwise used for financial gain, guests acknowledge that LUCHA Vacation Rentals VBA may pursue recovery of any associated profits, proceeds, royalties, damages, or revenue connected to such unauthorized use. Guests also agree to cooperate in removing unauthorized content from distribution upon request.
No Illegal Activities
Guests and all occupants are strictly prohibited from using the property for unlawful, illegal, or prohibited purposes. This includes, but is not limited to, the possession, manufacture, sale, transportation, or use of illegal drugs, contraband, prohibited substances, criminal activity, unauthorized adult entertainment productions, or any activity that violates local laws, HOA regulations, or government requirements.
Any illegal activity occurring at the property may result in immediate removal from the Accommodation, cancellation of the reservation without refund, notification of law enforcement, and additional legal or financial consequences.
Trespassing Prohibited
Guests are only permitted to access areas located within the boundaries of the reserved property and any specifically designated shared amenities.
Entering neighboring properties, restricted areas, construction zones, private docks, closed amenities, or unauthorized sections of surrounding communities is strictly prohibited. Guests remain fully responsible for any fines, claims, penalties, damages, or legal consequences arising from trespassing or unauthorized access.
Property Alterations
Guests may not alter, modify, damage, rearrange, or make changes to the property without prior written consent from LUCHA Vacation Rentals VBA.
This includes, but is not limited to:
Moving furniture between rooms or outdoors
Installing decorations or equipment
Painting or attaching materials to walls
Using nails, screws, adhesives, or mounting devices
Installing satellite dishes, antennas, or electronic equipment
Replacing locks or security devices
Displaying signs, banners, or promotional materials
Any unauthorzed modifications or damages resulting from such actions may result in repair charges or penalties.
HOA & Community Rules
Certain properties may be located within gated communities, condominium associations, residential developments, or HOA-managed neighborhoods. Guests acknowledge and agree that additional community rules, regulations, parking restrictions, quiet hours, security procedures, or “Good Neighbor Policies” may apply to the reservation.
Where HOA or local community rules impose stricter requirements than those contained within this Agreement, those rules shall take precedence and guests agree to fully comply with all such regulations during their stay.
Weapons, Violence & Hazardous Materials
Firearms, dangerous weapons, explosives, hazardous materials, illegal substances, or violent conduct are strictly prohibited at all properties managed by LUCHA Vacation Rentals VBA unless expressly permitted by applicable law and approved in writing.
Guests may not engage in threatening behavior, physical violence, fighting, reckless conduct, or any activity that endangers other guests, neighbors, staff, or the property.
Fireworks, pyrotechnics, flammable substances, hazardous chemicals, or combustible materials are strictly prohibited unless specifically authorized in writing. Charcoal, propane, or firewood may only be used in approved grills, fire pits, or designated outdoor cooking areas where permitted.
Any violation involving weapons, violence, hazardous materials, or fireworks may result in immediate eviction without refund, fines of at least USD $500, liability for all resulting damages, and potential involvement of law enforcement authorities.
Pools, Hot Tubs, Docks & Water Features
Guests acknowledge that swimming pools, hot tubs, spas, docks, ponds, lakes, beaches, and other water-related amenities involve inherent risks and must be used responsibly at all times.
By using these amenities, guests voluntarily assume all risks associated with their use and accept full responsibility for their own safety and the safety of all members of their group, including children and visitors.
Guests agree to follow all posted safety instructions and property guidelines, including:
No diving into pools, spas, or hot tubs
No glass containers near pool or spa areas
No intoxicated use of pools, spas, docks, or water amenities
Children must never be left unattended near water
Guests should avoid using pools or spas alone
Safety equipment may only be used during emergencies
No lifeguard or water safety personnel will be present at the property unless specifically stated otherwise. All use of water amenities occurs entirely at the guest’s own risk.
Where properties are located within HOA communities or condominium complexes, additional pool and amenity rules may apply, including restricted operating hours, supervision requirements, alcohol restrictions, shower requirements, or other community safety regulations. Guests agree to comply with all posted or provided rules relating to shared amenities and recreational facilities.
Trash Disposal
Guests are responsible for properly disposing of all trash during their stay and prior to check-out. Trash should be placed inside the designated exterior garbage bins assigned to the property whenever possible.
If trash bins are full or unavailable, securely tied trash bags should be placed in the designated area instructed within the house manual or communicated by LUCHA Vacation Rentals VBA staff. Guests are encouraged to notify Customer Support if garbage bins have reached capacity or require collection.
Failure to properly dispose of trash may result in additional cleaning charges, pest-related fees, odor remediation costs, or community fines where applicable.
Mail & Package Deliveries
Guests are generally not permitted to receive mail, parcels, packages, or deliveries directly at the property unless specifically approved in writing by LUCHA Vacation Rentals VBA prior to arrival.
Certain properties may not provide mailbox access, package handling services, or secure delivery areas. LUCHA Vacation Rentals VBA is not responsible for lost, delayed, stolen, damaged, misdelivered, or missing packages, mail, or deliveries sent to the property during a guest’s stay.
Changes to Terms & Policies
LUCHA Vacation Rentals VBA reserves the right to modify, update, amend, or revise the terms, conditions, policies, or rules contained within this Agreement at any time as deemed necessary for operational, legal, safety, or business purposes.
By making a reservation, accessing the property, or continuing to use the services provided by LUCHA Vacation Rentals VBA, guests acknowledge and agree that they have reviewed, understood, and accepted the most current version of the Guest Agreement and all related policies on behalf of themselves and all individuals included within the reservation.
Guest Acknowledgement
I/We, the undersigned guest(s), hereby confirm and agree that:
I/We are at least eighteen (18) years of age or older;
I/We have carefully reviewed, understood, and agreed to all terms, policies, rules, and conditions contained within this Guest Agreement;
I/We will use and occupy the property solely for lawful vacation and residential purposes in accordance with this Agreement;
I/We agree to comply with all applicable laws, HOA regulations, community rules, property instructions, and occupancy restrictions associated with the Accommodation;
I/We understand that any violation of this Agreement may result in immediate termination of the reservation, removal from the property without refund, additional fees, fines, or legal action where applicable;
I/We further acknowledge that this Agreement is accepted on behalf of all guests, occupants, and visitors included within the reservation party.
